1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pressure LLC ("Pressure," "Company," "we," "us," or "our"), governing your access to and use of the Pressure website, platform, dashboard, analytics tools, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
2. Eligibility, Minors, and Authority to Agree
You must be at least 13 years old to use the Service. If you are under 18 years old, or under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By accessing or using the Service, you represent and warrant that: - You are at least 13 years old. - If you are under 18 or under the age of majority where you live, your parent or legal guardian has reviewed and agreed to these Terms. - You have the legal capacity or other authority required to use the Service and enter into these Terms. - The information you provide to us is accurate and complete. - Your use of the Service complies with applicable law and applicable third-party platform terms, including Meta and Instagram requirements. The Service is not directed to children under 13. If we learn that a user under 13 has used the Service or provided personal information to us, we may suspend or terminate access and delete associated information as required by law.
3. Description of the Service
Pressure provides analytics, metrics, performance scoring, baseline comparisons, transcripts, structured feature generation, and other derived insights related to Instagram accounts that you authorize the Service to access. The Service may: - Retrieve authorized data from third-party services, including Instagram. - Process analytics, metadata, media URLs, and certain media-related assets needed to operate product features. - Generate performance metrics, scores, transcripts, feature labels, insights, recommendations, and other automated outputs. - Store and display historical analytics data and derived outputs. Pressure provides informational and analytical tools only. Pressure does not provide legal, tax, accounting, investment, employment, medical, or other professional advice, and does not guarantee accuracy, completeness, availability, predictive reliability, growth, engagement, revenue, or any other business outcome.
4. Third-Party Platforms and Meta / Instagram Integration
The Service integrates with third-party platforms, including Instagram and services made available by Meta. Your use of those platforms is governed by their own terms, privacy policies, platform rules, and technical limitations. Pressure: - Is an independent product and is not endorsed by, affiliated with, or sponsored by Instagram or Meta. - Does not control Meta or Instagram systems, platform decisions, API behavior, or availability. - Is not responsible for outages, platform changes, permission changes, deprecations, removals of data fields, account restrictions, or API limitations imposed by third parties. You may connect only accounts and data sources that you own or are authorized to manage. By connecting an account, you instruct Pressure to access, use, host, copy, process, and display the authorized data solely as reasonably necessary to provide, secure, support, and improve the Service in accordance with these Terms and our Privacy Policy.
5. Accounts, Credentials, and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, except to the extent caused by our own breach of these Terms or applicable law. You agree to: - Provide accurate, current, and complete information. - Keep your login credentials and devices secure. - Notify Pressure promptly of suspected unauthorized access or other security incidents. Pressure is not responsible for losses caused by your failure to protect your account, credentials, or connected third-party accounts.
6. Your Content, Authorized Platform Data, and Our Rights
You retain any rights you have in content and data you submit, connect, or make available through the Service, subject to the rights of Instagram, Meta, and any other third party that provides the underlying platform data. You grant Pressure a limited, non-exclusive, revocable, worldwide license to host, copy, cache, transmit, display, modify for formatting or technical purposes, and otherwise process your authorized data and related content solely as needed to provide, maintain, secure, support, and improve the Service and its features. Pressure retains all rights, title, and interest in and to the Service itself, including its software, interfaces, workflows, models, prompts, schemas, scoring systems, aggregated or de-identified analytics, documentation, branding, and any generic improvements developed through operating the Service. To the extent permitted by law, Pressure also owns service-generated outputs and analyses created by the Service, excluding your underlying content and excluding rights that belong to third-party platforms. Subject to these Terms, Pressure grants you a limited, non-transferable, revocable license to use the outputs generated for your account for your own lawful internal or personal use.
7. Acceptable Use
You agree not to: - Use the Service for unlawful, abusive, deceptive, or fraudulent purposes. - Attempt to reverse engineer, copy, scrape, benchmark, or disrupt the Service except as expressly permitted by law. - Interfere with system security or bypass rate limits, access controls, or account protections. - Access accounts, data, or integrations you do not own or have authority to use. - Use the Service in a way that violates Instagram, Meta, or other third-party platform terms. - Upload, transmit, or process material through the Service if you do not have the necessary rights or permissions. Pressure may investigate suspected misuse and may suspend or terminate accounts, limit functionality, or remove data where reasonably necessary to protect the Service, our users, or third parties.
8. Automated Processing and AI Features
Some Service features use automated systems, machine learning models, or AI-assisted processing to generate transcripts, classifications, scores, feature labels, summaries, recommendations, or other outputs. These outputs may be incomplete, inaccurate, outdated, biased, or unsuitable for your specific circumstances. You are solely responsible for reviewing outputs before relying on them. You must not treat Service outputs as a substitute for professional judgment or as the sole basis for legal, financial, employment, compliance, safety, or other high-impact decisions.
9. Service Availability and Product Changes
Pressure may add, remove, modify, suspend, or discontinue any feature, integration, metric, or functionality at any time, including when necessary because of third-party platform changes, security concerns, abuse prevention, legal requirements, beta limitations, or operational constraints. We do not guarantee that the Service, or any specific feature, metric, or integration, will remain available, compatible, or uninterrupted.
10. No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PRESSURE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. Pressure does not warrant that: - The Service will be uninterrupted, secure, or error-free. - Any analytics, scores, transcripts, or other outputs will be accurate, complete, or current. - The Service will prevent business loss or improve engagement, reach, revenue, or growth. - Defects will always be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESSURE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PRESSURE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO PRESSURE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100). The limitations in this section apply even if a remedy fails of its essential purpose and even if Pressure was advised of the possibility of the damages.
12. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Pressure and its affiliates, officers, directors, employees, contractors, and licensors from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: - Your use of the Service. - Your violation of these Terms. - Your violation of applicable law or third-party rights. - Data, content, or accounts that you connect, submit, authorize, or process through the Service.
13. Suspension and Termination
Pressure may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you violated these Terms, created risk for the Service or others, or if continued access is not commercially, technically, or legally feasible. You may stop using the Service at any time. Disconnecting Instagram stops future syncing but does not by itself require us to delete data already stored in our systems. For deletion options, see the Privacy Policy and the data deletion page. Upon suspension or termination: - Your right to use the Service ends immediately. - We may disable access to connected accounts and stored outputs. - We may delete or retain data in accordance with our Privacy Policy, legal obligations, security requirements, dispute preservation needs, and backup or retention practices. - Sections that by their nature should survive will survive, including provisions about ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.
14. Privacy
Use of the Service is also governed by our Privacy Policy, which describes how we collect, use, retain, disclose, and delete information.
15. Dispute Resolution; Arbitration; Class Action Waiver
Please contact us first if you have a dispute so we can try to resolve it informally. To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court if it qualifies. You and Pressure each waive any right to a jury trial and any right to participate in a class action, class arbitration, representative action, or private attorney general action to the fullest extent permitted by law. Arbitration will be conducted on an individual basis only. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for misuse of intellectual property, unauthorized access, breach of confidentiality, or other claims for which temporary relief is reasonably necessary.
16. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Washington, without regard to its conflict of laws principles, except to the extent preempted by applicable federal law or superseded by applicable consumer protection law.
17. Changes to These Terms
Pressure may update these Terms from time to time. The updated version will be posted through the Service with a revised effective or last-updated date. If you continue to use the Service after the updated Terms become effective, you agree to the updated Terms.
